What is a procedural deadline in civil litigation?
A procedural deadline is a legally defined timeframe within which (or not prior to which) a specific court action, brief, appeal, or filing must be completed, under penalty of forfeiture or procedural invalidity.
From which day does deadline counting begin (dies a quo)?
Under Art. 155 para 1 of the Italian Civil Procedure Code, the starting day is excluded from computation (dies a quo non computatur in termino), while the final day is included. Counting starts from the day immediately following the triggering event (service, hearing, or judgment filing).
What happens if a deadline falls on a Saturday or Sunday?
For ordinary forward deadlines (Art. 155 c.p.c.), expiration rolls forward to the first following business day (Monday). For backward deadlines (e.g., Art. 171-ter briefs), under Supreme Court En Banc Ruling No. 14437/2021, expiration moves backward to the preceding business day (Friday).
How does the August summer judicial recess work (1-31 August)?
Under Law 742/1969 as amended by Decree 132/2014, procedural deadlines are suspended by law from August 1 to August 31 (31 days). If a deadline starts before August 1, counting pauses and resumes on September 1. Urgent proceedings (injunctions, maintenance, labor) are exempt.
What are the deadlines for Cartabia Reform Art. 171-ter briefs?
Prior to the initial hearing, parties must file three consecutive briefs counted backward: 1st brief at least 40 days prior (new/modified claims and preliminary defenses), 2nd brief at least 20 days prior (replies and evidence), and 3rd brief at least 10 days prior (rebuttal evidence only).
